How does RAF Payments work?
RAF Payments offers an upfront cash payment against a valid Road Accident Fund court order or settlement agreement.
Once the Road Accident Fund pays your lawyers, the monthly RAF Payments charges will be taken off in one amount and you will receive the balance of your money in the final payment.
Can I apply for an RAF Payments advance if I’m blacklisted?
RAF Payments is not a loan. We, therefore, do not assess your credit score as part of our process. Clients who are blacklisted or with judgements may still apply.
What if I don’t have a bank account?
RAF Payments has a no-cash policy and will only release funds into a valid bank account.
Clients without a bank account are encouraged to open a new account at one of the registered banks in South Africa. Opening a new account can be done quickly, cheaply and conveniently.
How can I find out about the status of my Road Accident Fund claim?
RAF Payments is an independent company and is not a division of the Road Accident Fund.
All queries relating to the status of your RAF claim should be directed toward your attorney and/or the Road Accident Fund.

What agreements do I need to sign?
You will need to sign an agreement with RAF Payments that will set out your rights and responsibilities. This will include the upfront cash payment to be made to you and any costs involved. Your consultant will explain all costs before you sign and make sure that you understand the contract.
Your attorney will also need to sign that they acknowledge the agreement to protect the rights of both parties.
The RAF is not answering my calls.

Can I apply on behalf of a family member?
Yes.
Clients often rely on the assistance of family members and close friends to assist in applying for an RAF Payments cash advance.
However, the claimants themselves must be fully aware and select to enter into the RAF Payments transaction. Clients will need to sign all agreements themselves. Funds will need to be paid directly into the client’s bank account.
What if the funds are in a trust account?
Where a claimant is a child or in the event that a Trust has been established, the Trustee looks after the claimant’s funds. Therefore, the claimant or their family will not be able to engage RAF Payments without the consent of the Trustee.
Why do I need a lawyer to qualify for an advance?
Applying for an RAF Payments cash advance is only possible where clients have claimed using an attorney/lawyer. We are not able to help with an advance if a claim has been done directly with the RAF.
We need an attorney involved in the transaction for various reasons:
- Your attorney will ensure that your legal rights are being protected. It is critical that your attorney is fully on board and acknowledges the RAF Payments transaction. Where an attorney has specific issues or concerns, we will not be able to proceed until these are addressed.
- Your attorney firm has the necessary knowledge and bank structures to collect quickly and safely from the Road Accident Fund.
Do you work with all attorneys?
We work with most attorney firms in South Africa. There are certain firms which we do not work with. This includes firms that have been blacklisted by the Legal Practice Council, firms that do not have a valid Fidelity Fund Certificate, and where a director will not sign an undertaking acknowledging the RAF Payments transaction.
What can RAF Payments funds be used for?
RAF Payments will not ask any questions nor place any limitations on what you do with the funds provided.
Based on the feedback from past clients, some of the common uses of RAF Payments funds include:
- Assistance to cover daily living expenses,
- Repayment of outstanding debts,
- Payment of medical bills,
- Upgrading of home or car to support a disability,
- Payment for the education of oneself or one’s children,
- Investment to start a business or create other forms of income.
What if I have previously taken a loan with another RAF loan provider?
This is not a problem. You may still qualify for an RAF Payments advance depending on how much has already been borrowed from the other loan provider(s).

Why should I use an attorney/lawyer to claim against the RAF?
Claiming from the Road Accident Fund can be done either directly from the fund or with the help of a qualified attorney.
There can be several advantages to using an attorney:
- Having an experienced professional on your side will help you achieve the maximum claim payout.
- There are many law firms across the country that will be able to assist you on a no-win-no-fee basis. This means that they will work on your claim and only take their fees once your claim is settled.
When selecting an attorney, you should find a professional firm with experience and expertise in litigating against the Road Accident Fund. You should also ask to see an up-to-date copy of the firm’s fidelity fund certificate.
I have 100% merit, that means we won the case. Why can’t you help me?
A merit award is an important step in the RAF claims process and means that the court has acknowledged your claim to be valid.
The question still to be answered is how big or small the claim will be?
The claim size is determined through a second process known as ‘quantum’, which will result in a court order or settlement agreement.
RAF Payments cannot provide an advance until such time as the case is finalised and you and your attorney have proof of a valid court order or settlement agreement.
Does RAF Payments provide financial advice?
RAF Payments does not provide any financial advice on how best to structure your financial affairs, savings or investments.
Should you require financial advice, we will introduce you to a third-party accredited financial advisor who can assess your needs and provide you with a FREE quotation.
How do I find a RAF attorney?
RAF Payments is not a law firm.
You can find an RAF attorney/lawyer by searching online for ‘personal injury’ lawyers, or on the Legal Practice Council’s website www.lpc.org.za
It can also be helpful to ask for referrals if you have someone in your family or community who has successfully claimed from the RAF in the past.
I have a problem with my attorney, can you help?
Unfortunately, RAF Payments cannot help with complaints relating to your attorney.
Any questions relating to your attorney should be taken up directly with your attorney and the Road Accident Fund.

What is RAF Payments?

What do I need to qualify for a RAF Payments advance?

RAF Payments will make your first payment within 24 hours after the contract is signed by you and your attorney.
Your second payment will be paid as soon as the Road Accident Fund releases the payment to your attorney.
What supporting documents are required?
RAF Payments will require the following documentation from you before any funds can be disbursed:
- Court order or settlement agreement
- Copy of ID
- Proof of banking
- Proof of address
If you don’t have a copy of your Court Order or Settlement Agreement, RAF Payments can speak to your attorney to get a copy from them.
What are the monthly charges?
You do not have to make a monthly payment.
RAF Payments charges are based on how much money you choose to take upfront in your first payment and how long the Road Accident Fund takes to pay your attorney.
Your charges will be explained by your RAF Payments' consultant and will be clearly set out in the quote your receive.
Once the Road Accident Fund pays your lawyers, the monthly charges will be taken off in one amount and you will receive the balance of your money in your second and final payment.
There are no hidden costs.
What is a Court Order or Settlement Agreement?
A Road Accident Fund ("RAF") claim can be finalised in one of two ways:
- Court Order: this is when your attorney goes to court and a Judge orders the RAF to pay you a certain amount.
- Settlement Agreement: sometimes called a "Settlement Letter", this is when your attorney and the RAF have agreed on the amount that you will be paid without having to go to court.
Either of these documents will qualify you for a cash advance from RAF Payments.
How quickly can I expect my RAF Payments cash advance?
RAF Payments will release funds within 24 hours, from when the agreements are signed by you and your attorney!
The full process is often simple and can be very quick, however, there can sometimes be delays. The most common delays are collecting documentation and waiting for attorneys to sign the contract.
How much do I qualify for in my first payout?
First, we deduct your attorney’s fees from your RAF Court Order or Settlement Agreement, and then RAF Payments will be able to advance up to 40% of the amount left.
For Example:
If you have a court order of R1,000,000 of which the attorney’s fee is R250,000. The amount owing to you is R750,000. You are able to apply for up to R300,000 (40% of R750,000) as an immediate cash advance.

How long does the Road Accident Fund take to pay?
It takes a long time to claim from the Road Accident Fund (RAF). Claims take an average of 3-5 years from the date of claiming from RAF until the conclusion of the matter with a Court Order or Settlement Agreement.
However, getting your Court Order or Settlement Agreement is only the first step; the next challenge is waiting for payment from the RAF.
In many instances, payments from the RAF will take another 6 - 12 months and often longer.
The Road Accident Fund, your attorney or RAF Payments will not be able to guarantee when payment will be made by the RAF.
